Terms of Service

1. Agreement to Terms

By accessing or using BrandSentra ("the Service"), operated by Woost LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

BrandSentra is a brand protection and intelligence platform that monitors search engines, advertising platforms, and AI platforms to detect unauthorized use of brand keywords, affiliate fraud, trademark violations, and unauthorized advertisers. The Service includes automated scanning, violation detection, evidence collection, and enforcement tools.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service to monitor brands or keywords you do not own or have authorization to monitor
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, abuse, or harm third parties
  • Circumvent any security measures or rate limits
  • Resell, sublicense, or redistribute the Service without written consent
  • Use the Service in any way that violates applicable laws or regulations

5. Intellectual Property

The Service, including its design, features, code, and documentation, is the intellectual property of Woost LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All monitoring data generated by the Service for your account belongs to you.

6. Payment and Billing

Paid plans are billed on a monthly or annual basis as selected. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. The Service collects publicly available data from search engines and advertising platforms. We do not guarantee the accuracy, completeness, or timeliness of monitoring data.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Woost LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will detect all brand violations or that monitoring results will be error-free. The Service is a tool to assist with brand protection and does not constitute legal advice.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. We will retain your data for 90 days after termination, during which you may request an export. After 90 days, your data will be permanently deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
